New York currently requires hands-free devices to be used while driving, and a number of counties have passed their own laws banning texting while driving. There are also a number of pieces of legislation in the House and Senate which seek outlaw texting while driving.

PENDING LEGISLATION

PURPOSE OR GENERAL IDEA OF BILL :
The bill amends the current prohibition on using a hand held cell phone while driving to include text-based communication as well as requiring the pre-licensing course to include a component on “cell phone safety” and directing the commissioner to include at least one question on the hazards and legal consequences of using a cell phone while driving.
