New Mexico

In New Mexico, there are currently no cell phone restrictions besides those on drivers with intermediate licenses and those driving state vehicles. There are also local bans on cell phone use while driving in Albuquerque, Espanola, Gallup, Santa Fe and Taos. There is also pending legislation to outlaw the reading, writing, and sending of text messages while driving.

THE PENDING LEGISLATION

A person shall not operate a motor vehicle while using an electronic wireless communications device to write, send or read a text-based communication except:

  1. to report illegal activity;
  2. to summon medical or other emergency help;
  3. to prevent injury to a person or property;
  4. while the motor vehicle is lawfully parked;
  5. in the operation of an authorized emergency vehicle; or
  6. to relay information between a transit or for-hire operator and that operator‛s dispatcher when the device is permanently affixed to the vehicle.
