Delaware

Delaware prohibits all novice drivers from texting or from using their cell phones while driving. Full driving privilege starts at age 17 or at least 6 months. However, there is pending legislation which seeks to ban all text messaging while driving. This bill includes a $50 fine and counts texting as a primary offense.

THE PENDING LEGISLATION

No person shall use a mobile telephone or other electronic device to send a text message or email while operating a moving motor vehicle in this State. For the purposes of this Section the term ‘mobile telephone’ means any cellular, analog, wireless, or digital device capable of sending or receiving a telephone, text or email message without an access line for service.
